Terms of Service

1. Acceptance of Terms
By downloading, installing, or using QuackDB (the "Service"), you agree to be bound by these Terms of Service ("Terms") and the Privacy Policy. If you do not agree to these Terms, do not download, install, or use the Service.
The QuackDB application is free to download with limited functionality. Whether you use the free tier or a paid subscription, your download and use of the application constitutes acceptance of these Terms and the Privacy Policy.
These Terms constitute a legally binding agreement between you and Zukic.T. ("I," "me," or "my"), the individual developer and operator of QuackDB.
By using the Service, you represent that you are at least 16 years of age and have the legal capacity to enter into these Terms.
2. Service Description
QuackDB is a desktop database management application that allows you to connect to, view, query, and manage databases on your local computer. The Service includes:
- The QuackDB desktop application for macOS, Windows, and Linux
- The QuackDB website at quackdb.app
- Related documentation and support resources
QuackDB operates entirely on your local machine. Your databases, queries, and data remain on your computer and are not transmitted to me or any third party through the application.
3. Accounts
3.1 Account Creation
To access certain features, you may need to create an account. You agree to provide accurate and complete information when creating your account and to keep this information up to date.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify me immediately of any unauthorized use of your account.
3.3 Account Termination
You may delete your account at any time by contacting me. I reserve the right to suspend or terminate your account at any time, for any reason, with or without notice.
4. License to Use
Subject to your compliance with these Terms, I grant you a limited, non exclusive, non transferable, revocable license to download, install, and use the QuackDB application on devices you own or control, solely for your personal or internal business purposes.
This license does not include the right to:
- Sublicense, sell, resell, or transfer the Service
- Modify, adapt, or create derivative works of the Service
- Reverse engineer, decompile, or disassemble the Service
- Remove or alter any proprietary notices or labels
5. Restrictions
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the integrity of the Service
- Use the Service to transmit malware, viruses, or harmful code
- Use the Service to infringe on the rights of others
- Share your account credentials with others
- Use automated means to access the Service without permission
- Circumvent any access restrictions or licensing controls
6. Pricing and Payment
6.1 Free Tier
QuackDB offers a free tier with core functionality. The free tier is available indefinitely at no cost.
6.2 Pro Subscription
The Pro subscription provides additional features and is available at the following prices:
- Monthly: $9.99 USD per month
- Quarterly: $24.99 USD every three months
All prices are in United States Dollars (USD). Applicable taxes may be added at checkout.
6.3 Right to Change Pricing
I reserve the right to change pricing at any time and for any reason at my sole discretion.
If I change pricing, I will provide advance notice via email before the change takes effect. Price changes will not affect your current billing period. New prices will apply to your next renewal after the notice period.
6.4 Payment Processing
Payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service. I do not have access to your full payment card details.
7. Subscriptions
7.1 Automatic Renewal
Pro subscriptions automatically renew at the end of each billing period at the then current rate unless you cancel before the renewal date.
7.2 Cancellation
You may cancel your subscription at any time through your account settings or by contacting me. Upon cancellation, you will retain access to Pro features until the end of your current billing period.
7.3 Free Trials
I may offer free trials from time to time. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the then current rate.
8. Refunds
All sales are final. Due to the nature of digital products and the immediate access provided upon purchase, I generally do not offer refunds.
I may consider refund requests on a case by case basis at my sole discretion in exceptional circumstances, such as genuine technical issues that prevent you from using the software.
If you believe you are entitled to a refund, contact me within fourteen (14) days of purchase with details of the issue.
Initiating a chargeback without first contacting me may result in immediate termination of your account.
9. Service Modifications
I reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.
I may add, change, or remove features at my sole discretion. I am not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
I will make reasonable efforts to notify active subscribers of significant changes that materially affect the Service.
10. Intellectual Property
The Service and its original content, features, and functionality are owned by Zukic.T. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
"QuackDB" and associated logos are trademarks of Zukic.T.. You may not use these marks without prior written permission.
Nothing in these Terms grants you any right, title, or interest in the Service except for the limited license granted in Section 4.
11. User Content
Your data is yours. QuackDB operates locally on your machine. Your databases, queries, files, and data remain on your computer and under your control.
You are solely responsible for your data, including ensuring you have the right to access and use any databases you connect to with QuackDB.
If you submit content to me (such as bug reports or feature requests), you grant me a non exclusive, royalty free, worldwide license to use, reproduce, and modify that content for the purpose of improving the Service.
12. Third Party Services and Databases
12.1 Third Party Services
The Service may integrate with or link to third party services such as Stripe for payment processing. Your use of third party services is subject to their respective terms and privacy policies.
I am not responsible for the content, policies, or practices of any third party services. Your interactions with third parties are solely between you and that third party.
12.2 Databases You Connect To
QuackDB is a tool that allows you to connect to and interact with databases. I do not own, operate, control, or have any responsibility for the databases you connect to.
You acknowledge and agree that:
- You are solely responsible for any databases you connect to using QuackDB
- You must have proper authorization to access any database you connect to
- You are responsible for maintaining backups of your data
- Any actions you take on a database (queries, modifications, deletions) are your responsibility
- I am not liable for any data loss, corruption, or damage to your databases
- I am not liable for any unauthorized access to databases you connect to
- I am not liable for any issues with third party database hosting services
USE QUACKDB AT YOUR OWN RISK. ALWAYS MAINTAIN BACKUPS OF IMPORTANT DATA. I AM NOT RESPONSIBLE FOR ANY DAMAGE TO OR LOSS OF DATA IN DATABASES YOU CONNECT TO.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
To the fullest extent permitted by law, I disclaim all warranties, including but not limited to:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non infringement
- Accuracy, reliability, or completeness of information
- Uninterrupted or error free operation
- Security or freedom from viruses or harmful components
I do not warrant that the Service will meet your requirements, achieve any intended results, or be compatible with any other software, systems, or services.
14. Limitation of Liability
IN NO EVENT SHALL I BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunities
- Loss of data or data corruption
- Loss of goodwill or reputation
- Cost of substitute goods or services
- Any other intangible losses
This applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if I have been advised of the possibility of such damages.
You acknowledge that you use the Service at your own risk. I am not liable for any damages resulting from your use of the Service, including but not limited to damages to your computer, loss of data, or any issues with databases you connect to.
My total cumulative liability to you for any and all claims arising from or related to the Service shall not exceed the greater of: (a) the amount you paid me in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100 USD).
15. Indemnification
You agree to indemnify, defend, and hold harmless Zukic.T. from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of any third party
- Your violation of any applicable laws or regulations
- Any content you submit or transmit through the Service
- Any claim that your use of the Service caused damage to a third party
This indemnification obligation shall survive termination of these Terms and your use of the Service.
16. Termination
16.1 Termination by You
You may stop using the Service at any time. You may delete your account by contacting me. Upon deletion, your account information will be removed in accordance with my Privacy Policy.
16.2 Termination by Me
I reserve the right to suspend or terminate your access to the Service at any time, for any reason, with or without notice, at my sole discretion.
Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent activity, chargebacks, or conduct that I determine to be harmful to me or other users.
16.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.
17. Governing Law and Dispute Resolution
17.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles.
17.2 Binding Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.
The arbitration shall take place in Washington State, United States, and shall be conducted in English. The arbitrator's decision shall be final and binding.
17.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
You waive any right to participate in a class action lawsuit or class wide arbitration against me.
17.4 Exceptions
Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights.
18. Changes to Terms
I reserve the right to modify these Terms at any time, for any reason, at my sole discretion.
When I make changes, I will update the "Last updated" date at the top of these Terms. For material changes, I will provide notice via email to the address associated with your account before the changes take effect.
Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
19. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms.
The invalidity of any provision shall not affect the validity or enforceability of any other provision of these Terms, and all remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and me regarding the Service and supersede all prior agreements, understandings, and representations.
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
